Penalties

Most federal crimes are defined in Title 18 of the United States Code, and the Federal Sentencing Guidelines are typically followed to uniformly punish federal offenses.  Penalties for federal crimes can often include prison time and fines.  For example, under the federal drug possession and trafficking statutes, the Controlled Substances Act (21 U.S.C. §§ 807 et seq.), punishments can range from less than one year in federal prison to life without parole. Fines can vary from $1,000 to $10,000,000 depending on your charge.

Agencies Who Investigate and Prosecute Federal Offenses

Federal agencies investigate federal offenses before they are prosecuted by the Unites States Attorney’s Office.  The most common U.S. investigative agencies are the Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The FBI has jurisdiction over a wide range of federal crimes, and investigates almost any crime associated with federal offenses.  The DEA primarily investigates felony drug crimes, including drug smuggling into the United States from other countries.  The ATF is an investigative agency for violent crimes, criminal organizations, weapon trafficking and terrorism.

United States Attorneys prosecute crimes after they have been investigated by a federal agency.  Each United States Attorney is appointed by the President of the United States and is assigned to one of the 94 judicial districts.  They collectively serve under the direction of the United States Attorney General.
